Stages of the law enforcement process
A special form of law enforcement is its application, ie the activity of the competent state authorities in applying the legal norms to a particular case.
The law enforcement process consists of several stages:
1. Determining the actual circumstances of the case. It is determined by the help of proven facts. The person applying the rule of law must select, analyze, and evaluate those facts in order to clarify the legal case.
2. Selection and analysis of applicable law norms applicable to actual cases. At this stage, the body applying the right determines which norm is applied on the case. At this point you need to get the latest version of the norm. In general, the applicable norm should be examined in detail, in terms of space, time and space. During the analysis, it may be apparent that a situation can be regulated by several norms, even those that are contrary to one another. This is called a collision of legal norms. The collision is solved in several ways, including the application of the superior body or the latter.
3. Decision of the competent authority and delivery of this decision to the relevant parties and organizations:
This stage is the crucial and crucial stage of the legal process. After passing the above steps, the competent authority shall make a decision on behalf of the State and shall announce it to the persons concerned and to the relevant authorities.
